A new academic paper published by Al-Zaytouna Centre for Studies and Consultations, entitled “The Legislative and Political Environment in Palestine (2010–2026): An Analytical Study of the Evolution of Presidential Decree-Laws and Their Implications for State-Building and National Unity ,” by Dr. Dirar Musa Abu Sisi, examines the evolution of presidential decree-laws and their implications for Palestinian state-building, judicial independence, civil liberties and national unity amid the absence of the Palestinian Legislative Council (PLC) and the continuing political schism.

The study finds that the growing reliance on decree-laws has turned exceptional legislation into routine practice, weakening parliamentary oversight and the separation of powers while raising questions about legislative legitimacy and oversight of the issuance and implementation of laws.

Abu Sisi also examines several legislative examples, including the Social Security Law and the Cybercrime Law, highlighting their potential implications for social rights and freedom of expression. In addition, he assesses the effects of administrative and financial decisions affecting the Gaza Strip and their broader repercussions for Palestinians amid the continuing schism.

The study calls for an end to the growing reliance on unilateral legislation, stronger judicial independence and civil liberties, and the restoration of democratic life through general elections. It also recommends reviewing fiscal policies and directing public spending toward development to strengthen Palestinian society’s resilience. Finally, it advocates a unified national strategy involving all national and Islamic political forces and factions to resist annexation and displacement and safeguard the Palestinian people’s national and political identity throughout the West Bank, Jerusalem and Gaza Strip.
